Executive Summary
Context: 2024 national budget was presented to the Parliament and taxes were increased. Police arrested four top health officials including a director of Ministry of Health, concerning a scam involving medical supplies. Meanwhile, the Election Commission confirmed holding the next Presidential Election between September – October 2024. A top Police official Deshabandu Tennakoon, currently facing multiple legal cases and accusations relating to human rights violations was appointed as the Acting Inspector General of Police. Accusations against him include torture of detainees, negligence of duties relating to the Easter Sunday bomb attack, and attack to peaceful protesters in Galleface etc. Two custodial deaths were reported in Northern and Eastern Provinces. A 13-year-old child, a 26-year-old young man died at the detention facilities, with signs of torture. Maaveerar Naal (the Great Heroes Day), an annual event to remember the Tamil martyrs who lost their lives during the civil war, was commemorated in multiple towns in the North and East. The protest organised by Tamil farmers in Mylathamadu, Batticaloa against the encroachment of their grazing lands by people from other districts continued throughout the month. The Magistrate ordered the eviction of 13 recent settlers in the disputed state-owned land. A protest was organized demanding the removal of the Sri Lankan military from a former LTTE cemetery in Mullaitivu, Fisherfolk cooperative communities held a press briefing opposing the proposed Fisheries Act that will allow foreign vessels to engage in fishing in Sri Lankan waters, bringing serious challenges to the small-scale fishing communities.
Case updates: The Supreme Court (SC) declared certain regulations gazetted under Prevention of Terrorism Act (PTA) two years ago, as null and void as they violated the Fundamental Rights. These regulations expanded the powers of the controversial PTA that has been historically used for arbitrary arrest and detention of human rights defenders, ethnic minorities and others. The SC gave another landmark judgement that the public trust and equality before law had been violated by several leading politicians and several top state officials involved with the former government by leading the country’s economy to a crisis. The SC ruled that the Online Safety Bill can be passed by a simple majority subjected to 31 amendments, otherwise require a special majority in the parliament. The SC decided that political commentator Mohammad Ramzy Razeek’s arrest and subsequent incarceration in April 2020 under ICCPR Act violated his fundamental rights. The Colombo Magistrate Court ordered the Police to report to the court the progress of the investigation into the alleged incident in which a group including a former minister, Marvin Silva, broke into the state-owned Television Corporation and assaulted a group of employees there 16 years ago. Issuing a statement, the Ministry of Defence has denied and denounced the claims made by UK based TV channel Channel 4 of orchestrating the Easter Attacks by Sri Lankan politicians and the military. In September, Channel 4 aired a documentary that included claims by a former government aide, that a top intelligence official met with members of the terrorist group that carried out the bomb attacks as part of an alleged plot to help former Sri Lankan president Gotabaya Rajapaksa to win the election by creating a national security crisis in the country. The former head of the investigation into the Easter Sunday attacks has spoken out for the first time, claiming that political intervention hampered the police inquiry. Former Deputy Inspector General of Police Ravi Seneviratne claimed his team was removed from the case when Rajapaksa seized office six months after the attacks. Seneviratne said that his lead investigator was fired without reason “immediately after the new government was elected”. The parents of 11 youngsters whom a group of navy personnel allegedly abducted held a demonstration in front of the Supreme Court, demanding justice for their missing children. They stated that the Attorney General’s Department’s failure to address this matter had impeded justice for more than 15 years. The AG’s Department had withdrawn the indictment they filed against a key suspect. The Second phase of the excavation of the Kokkuthuduvai mass grave was carried out in late November, while a total of 40 individual human skeletons were found during both phases. The next excavation phase is planned to be held on 1st March 2024.
Former president Mahinda Rajapaksa’s elder son and Sri Lanka Podujana Peramuna (SLPP) MP Namal Rajapaksa, along with five others, have been acquitted in the Gowers Corporation money laundering case by the Colombo High Court.
The main suspect who threatened Janaka Rathnayake with death and tried to extort money from the former chairman of the Public Utilities Commission has been arrested. The Police Media Unit said that the suspect was arrested by the Colombo Crime Division.
Repression of Media and Journalists: Terrorism Investigation Department has summoned the editorial board member and journalist of the Jaffna based Uthayan newspaper Dileep Amuthan, in relation to an article that was published in 2020 on Maaveerar Naal. Kurunegala based Provincial Journalist Dineth Kumara working for state operated Rupavahini Corporation was severely assaulted and arrested by the officers of the Bingiriya Police station. A group of local and foreign journalists have been stopped at a checkpoint over two hours and recorded their personal details, including their identity card issued by the Government Information department, their home addresses and their workplace addresses.

Repression of Freedom of Assembly: Santhiveil police arrested 6 Jaffna University students who supported the Mylathamadu livestock farmers protest when they were travelling back to Jaffna once the protest finished. The police obstructed a protest organized by medical students of the University of Sabaragamuwa and arrested 21 students.
The police dispersed the protest and arrested six protesters who staged a protest in Horagasmulla, Gamapha, against increasing the electricity tariffs. Colombo Fort Magistrate issued an injunction preventing a protest organized against the increased electricity tariff approaching the Presidential Secretariat, President’s House and the Ministry of Finance premises.
Several incidents were reported from Eastern Province where Police obstructed the Maaveerar Naal commemoration. The broken headstones in a LTTE graveyard that were initially destroyed by the state after the end of the armed conflict had been crushed into small pieces by unknown individuals, as local youth arranged the broken parts for a remembrance event. Police obstructed and stopped Tamil civilians from attending the Maaveerar Commemoration held at the cemetery where the deceased Tamil buried during the civil war. In another incident, Police forcefully entered and removed the decoration of the Batticaloa commemoration of Maaveerar Naal. Valaichenai Police demolished the monument that was created to commemorate Maaveerar Naal on 27th November. The police said they have destroyed it according to a court order. Sambur police stopped a group of Tamil individuals who were on their way to attend the Maaveerar Naal Commemoration at Mutur, near Sambur police station. Valachchenai Police arrested 6 residents and confiscated their speakers, the generator used to organise the event.
While many police stations in the North and East requested court orders to ban Maaveerar Naal Commemorations, only several courts issued such orders banning the events. Police also prohibited the use of the karthigai poo – the Tamil national flower – at Maaveerar Naal commemorations in Mullaitivu.
Legal and Policy Actions: A Gazette notification declaring postal service as essential service was issued, in the context of postal services employees have initiated trade union action. Essential service declarations are generally used to crack down and threaten workers who engage in trade union action. With immediate effect, the postal department has cancelled the leave of all the postal employees on November 8, 9, and 10. This action was taken when postal employees initiated a protest against selling the Nuwaraeliya and Kandy postal offices. Another gazette was issued declaring that all the services connected to the supply of electricity and supply and distribution of petroleum products and fuel made an essential service.
The monthly gazette was issued for all forces to follow the public security ordinance, providing the powers for the armed forces to intervene in civilian affairs.
The National Peace Council has issued a statement concerning the new Office for National Unity and Reconciliation Act. They have expressed concerns about the power that has been given to the ONUR to oversee and facilitate peace and reconciliation programs conducted by local organizations, including community-based organizations.
Other incidents: The leader of the Democracy Party, N. Nagules, was arrested while attending a Maaveerar Naal event, and remanded until December 7th. The Lawyers Collective has issued a statement calling for a response regarding allegations made by the former sports minister Roshan Ranasinghe, regarding some alleged favourations by a judge regarding Sri Lanka Cricket Board interim Committee. A tense situation arose in Parliament when a group of SLPP MPs impeded Opposition Leader Sajith Premadasa’s queries about the Supreme Court verdict that holds the Rajapaksas accountable for Sri Lanka’s economic collapse.

ජනක රත්නායක ට මරණීය තර්ජන එල්ල කළ සහ මහජන උපයෝගිතා කොමිසමේ හිටපු සභාපතිගෙන් කප්පම් ලබා ගැනීමට සූදානම් වූ ප්රධාන සැකකරු අත් අඩංගුවට පත් විය. සැකකරු අත් අඩංගුවට ගනු ලැබුවේ කොළඹ අපරාධ කොට්ඨාශය මගින්යැයි පොලිස් මාධ්ය ඒකකය පැවසුවේය.

රැස්වීමේ නිදහස මර්දනය: මයිලතාමඩු කිරිපට්ටි ගොවින්ගේ විරෝධතාවයකට සහභාගි වී ආපසු පැමිණෙමින් සිටි යාපනය විශ්ව විද්යාලයේ ශිෂ්යයන් හය දෙනෙකු සාන්තිවේල් පොලිසිය විසින් අත් අඩංගුවට ගෙන ඇත. සබරගමුව විශ්ව විද්යාලයේ වෛද්ය ශිෂ්යයන් සංවිධානය කළ විරෝධතාවයකට බාධා කළ පොලීසිය ශිෂ්යයන් 21ක් අත් අඩංගුවට ගත්තේය.
විදුලි ගාස්තු වැඩි කිරීමට එරෙහිව ගම්පහ හොරගස්මුල්ල ප්රදේශයේ සංවිධානය කළ උද්ඝෝෂණයක් විසුරුවා හැරි පොලීසිය විරෝධතාකරුවන් හය දෙනකු අත් අඩංගුවට ගත්තේය. කොළඹ කොටුව මහෙස්ත්රාත් විදුලි මිල වැඩි කිරීමට එරෙහිව උද්ඝෝෂණය කළ විරෝධතාකරුවන්ට ජනාධිපති ලේකම් කාර්යාලය, ජනාධිපති නිවස සහ මුදල් අමාත්යංශ පරිශ්රයට ඇතුලුවීම වළක්වන තහනම් නියෝගයක් නිකුත් කෙළේය.
පොලිසිය මහාවීර් නාල් සැමරුම පැවැත්වීමට බාධා කළ නිසා නැගෙනහිර පළතෙන් සිද්ධීන් ගණනාවක්ම වාර්තා විය. රජය විසින් සන්නද්ධ ගැටුම මර්දනය කිරීමෙන් පසුව එල්ටිටීඊ සුසාන භූමියක ඉදි කර තිබු සොහොන් කොත් නොහඳුනන පුද්ගලයන් විසින් විනාශ කර දැමීමෙන් පසුව අනුස්මරණ කටයුත්තක් ලෙස ප්රදේශයේ තරුණයෝ ඒවා නැවත ඉදි කිරීමට පියවර ගත්හ. සිවිල් යුද්ධයේ දි මිය ගිය දෙමළ ජාතිකයන් මිහිදන් කර තිබු සොහොන් භූමියක පැවැත්වීමට සැලසුම් කළ මහාවීර් අනුස්මරණයට පැමිණීමට පොලීසිය විසින් ජනතාවට බාධා කොට නවත්වන ලදී. තවත් සිද්ධියක දී මහාවීර් නාල් අනුස්මරණය සඳහා මඩකලපුවේ ඉදි කර තිබු සැරසිලි පොලීසිය පැමිණ බලහත්කාරයෙන් ඉවත් කරන ලදී. නොවැමිබර් 27 වැනි දා වාලච්චේනයි පොලීසිය මහාවීර් නාල් අනුස්මරණය සඳහා ඉදි කර තිබු ස්මාරකයක් කඩා බිඳ දැමුවේය. එය අධිකරණ නියෝගයක් මත විනාශ කර දැමුවේයැයි පොලිසිය පවසයි. මුතූර් හි පැවැත්වෙන මහාවීර් නාල් අනුස්මරණයකට සහභාගිවීමට පැමිණි දෙමළ පුද්ගලයන් කණ්ඩායමක් සාම්පූර් පොලීසිය විසින් පොලීසිය ඉදිරි පිට දී නවත්වන ලදී. වාලච්චේනෙයි පොලීසිය උත්සවය සංවිධානය කිරීමට ගෙනවිත් තිබු ශබ්ද විකාශන යන්ත්රය සහ විදුලි ජනන යන්ත්රය අත් අඩංගුවට ගත්තේය.
උතුර සහ නැගෙනහිර පොලීසි කීපයක්ම මහාවීර් නාල් උත්සවය තහනම් කිරීමට උසාවි නියෝග ඉල්ලා සිටිය ද එවැනි නියෝග ලැබුණේ උසාවි කීපයකින් පමණි. මුලතිවු හි පැවති මහාවිර් නාල් උත්සවයක දී දෙමළ ජාතික පුෂ්පය වූ කාර්තිගල් පූ යොදා ගැනීම පොලීසියෙන් තහනම් කරන ලදී.
නෛතික සහ ප්රතිපත්ති පියවර: තැපැල් සේවකයන් වෘත්තිය සමිති පියවරක් ගැනීමට සූදානම් වූ නිසා තැපැල් සේවාව අත්යවශ්ය සේවාවක් සේ ප්රකාශයට පත් කොට ගැසට් කරන ලදී. වෘත්තීය ක්රියා මර්ගයක් ගැනීමට සේවකයන් සූදානම් වන විට එම සේවාව අත්යවශ්ය සේවාවක් සේ නම් කිරීම වෘත්තීය ක්රියා මාර්ග මර්දනය කිරීමට ගන්නා සාමාන්ය පියවරකි. තැපැල් දෙපාර්තමේන්තුව වහාම නොවැම්බර් 8, 9, සහ 10 දිනවල තැපැල් සේවකයන්ගේ නිවාඩු අවලංගු කරන ලදී. මෙම පියවර ගත්තේ තැපැල් සේවකයන් මහනුවර සහ නුවරඑළිය තැපැල් කාර්යාල විකිණීමට එරෙහිව විරෝධතාවයක් ආරම්භ කිරීමට සූදානම් වෙමින් සිටිය දීය. විදුලිය සැපයීමට සම්බන්ධ සියලු සේවාත්, පැට්රෝලියම් නිෂ්පාදන සහ ඉන්ධන සැපයීම සහ බෙදා හැරීම අත්යාවශ්ය සේවා බවට නම් කොට තවත් ගැසට් නිවේදනයක් නිකුත් කරන ලදී. මහජන ආරක්ෂක පනත යටතේ සන්නද්ධ හමුදාවට සිවිල් කටයුතුවලට මැදිහත්වීමට ඉඩ සැලසෙන මාසික ගැසට් නිවේදනය නැවතත් නිකුත් කරන ලදී.
ජාතික සාම මණ්ඩලය ජාතික එකමුතුව සහ සංහිඳියාව සඳහා නව කාර්යාලයක් විවෘත කිරීම සම්බන්ධයෙන් ප්රකාශයක් නිකුත් කර ඇත. ප්රජා මූලික සංවිධාන ඇතුළත් දේශීය සංවිධාන පවත්වන සාමය සහ සංහිඳියා වැඩ සටහන් අධීක්ෂණයට සහ පහසුකම් සැපයීමට ONUR කාර්යාලයට ලබා දී ඇති බලතල ගැන ඔවුහු කනස්සල්ල ප්රකාශ කළහ. වෙනත් සිද්ධීන්: ප්රජාතන්ත්රවාදී පක්ෂයේ නායක එන් නගුලේස් මහාවීර් නාල් උත්සවයකට සහභාගි වෙමින් සිටිය දී අත් අඩංගුවට ගෙන දෙසැම්බර් 7 දක්වා රක්ෂිත බන්ධනාගාර ගත කරන ලදී. ශ්රී ලංකා ක්රිකට් මණඩලයට පත් කරන ලද අන්තර්වාර කොමිටිය සම්බන්ධයෙන් විනිසුරුවරයෙකු පක්ෂපාතීව කටයුතු කෙළේයැයි හිටපු ක්රීඩා ඇමති රොෂාන් රණසිංහ කරන ලද ප්රකාශය ගැන ප්රතිචාරයක් දක්වන ලෙස ඉල්ලා නීතිඥ සාමුහිකය ප්රකාශයක් නිකුත් කර ඇත. ශ්රී ලංකාවෙ ආර්ථිකය කඩා වැටීම සම්බන්ධයෙන් රාජපක්ෂ පාලනය වගකිව යුත්රයැයි ශ්රේෂ්ඨාධිකරණයෙන් ලබා දී ඇති නඩු තීන්දුව ගැන විපක්ෂ නායන සජිත් ප්රේමදාස පාර්ලිමේන්තුවේ දී ප්රශ්න කළ විට ශ්රී ලංකා පොදු ජන පෙරමුණේ මංත්රීන් විරුද්ධ වීමෙන් පාර්ලිමේන්තුවේ උණුසුම් තත්වයක් ඇති විය.
